FastoAi Service reserves the right, at its sole discretion, to change, add or remove portions of this Terms of Service at any time. It is your responsibility to check this Terms of Service each time before using the Site FastoAi. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. You agree that all subsequent purchases by you will be subject to the terms and conditions of this Terms of Service, which shall apply until we post a modified Terms of Service and then in accordance with such modified Terms of Service. As long as you comply with this Terms of Service and any such modifications, The FastoAi grants you ("End User") a personal, non-exclusive, non-transferable, non-sub licensable, limited privilege to enter and use the Site.

Registration, Customer Accounts, Use of Site 

Certain services offered on or through the Site require you to first open a Customer Account. You are responsible for maintaining the confidentiality of your Customer Account information, including your password, and for all activity that occurs under your account. You agree to notify FastoAi immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by FastoAi or any other user of the Site due to someone else using your password or customer account. You may not use anyone else's password or customer account at any time. You may not attempt to gain unauthorized access to the Site. Should you attempt to do so, assist others in making such attempts, or distributing instructions, software or tools for that purpose, then your Customer Account will be terminated. You agree to provide us with accurate, current and complete information about yourself and your billing information as prompted by the registration process. You may update any of your Customer Account information by clicking on the “Update Address” link when checking out. You may not use any automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy, probe, test or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or any of the systems or networks comprising or connected to the Site.

You also agree that FastoAi may, in its sole discretion and without prior notice to you, terminate your access to the Site and your Customer Account for any reason, including without limitation: (1) attempts to gain unauthorized access to the Site or assistance to others' attempting to do so, (2) overcoming software security features limiting use of or protecting any Content, (3) discontinuance or material modification of the Site or any service offered on or through the Site, (4) violations of this Terms of Service, (5) failure to pay for purchases, (6) suspected or actual copyright infringement, (7) unexpected operational difficulties, or (8) requests by law enforcement or other government agencies. You agree that FastoAi will not be liable to you or to any third party for termination of your access to the Site.

As more fully described in our Privacy Policy, you must disclose certain Personally Identifiable Information to use our Site, register, and make purchases. As a condition of registering with our Site or making any purchases of any products and/or services or conduct any transactions, you represent that you have first read our Privacy Policy and consent to the collection, use and disclosure of your Personally Identifiable Information and Non-Personally Identifiable Information as described in our Privacy Policy. IN NO EVENT SHALL FastoAi OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, A THIRD PARTY'S UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER THE PADDLE STORE WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.

By establishing a Customer Account with us, and each time you make a purchase through our Site, you grant permission for FastoAi to contact you at your e-mail address. To stop receiving our marketing emails, follow the opt-out procedures set forth in such marketing emails.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in US dollars.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. If your order is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

Term and payment modalities

The duration of your subscription depends on whether you have chosen a "Monthly Plan" or a "Yearly Plan". Yearly Plan: With a Yearly Plan, you agree to pay the price specified for the respective product (Basic Plan, Standard Plan, Professional Plan, Business Plan, Extended Plan) for a period of 12 months in advance. You may cancel the subscription at any time during the initial 12-month period, effective on the date that is 12 months after the date you enter into the agreement and equal in number to the date you entered into the agreement (example: If you enter into the contract on 01/03/2023, you can cancel at any time with effect from 01/03/2024). If you do not cancel the subscription within 12 months from the conclusion of the contract, the subscription will be renewed for another 12 months and you will be obliged to pay the specified price for a period of 12 months in advance. Cancellation is possible at any time with effect from the day that is 12 months after the start of the renewal and equal in number to the date of renewal. The contract will be repeatedly renewed for 12 months, subject to the rules just described, until it is terminated. FastoAi may refuse to renew the contract. Monthly Plan: With a Monthly Plan, you agree to pay the price specified for the particular product (Basic Plan, Standard Plan, Professional Plan, Business Plan, Extended Plan) for a period of 1 month in advance. You can cancel the subscription at any time during the first month with effect from the day that is 1 month after the conclusion of the contract and is equal in number to the day of the conclusion of the contract (example: If you enter into the contract on 01/03/2023, you can cancel at any time with effect from 01/04/2023). If you do not cancel the subscription within one month from the conclusion of the contract, the Monthly Plan will automatically convert into a Yearly Plan of the selected price level (Basic Plan, Standard Plan, Professional Plan, Business Plan, Extended Plan). The prices stated at the time of booking your Monthly Plan apply in the event of conversion of a Monthly Plan to a Yearly Plan. In this case, the regulations just described for the Yearly Plan apply, with the proviso that the day on which the Monthly Plan is converted into the Yearly Plan is deemed to be the day on which the contract is concluded.

Seven Days Money Back Guarantee

We provide every customer with a 7 Days money-back guarantee. This means that you can cancel your subscription within 7 days without giving any reason, and you will be refunded the payments you have already made. This applies also to the Monthly Plan. However, your right to cancel the contract will not be renewed if the Monthly Plan is converted to the Yearly Plan. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU EXPRESSLY AGREE AND ACKNOWLEDGE THAT FastoAi WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND INCLUDING AND WITHOUT LIMITATION, WHETHER DIRECT, INDIRECT, OR INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT AND INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA OR OTHER INTANGIBLE LOSSES, LOSS OF PROFITS, GOODWILL, PROCUREMENT COST OF GOODS OR ALTERNATE OR SUBSTITUTE SERVICES AND GOODS OR SERVICES OR GOODS RESULTING FROM ANY DATA, CONTENT, INFORMATION, OR SERVICES PURCHASED OR OBTAINED, (EVEN IF FastoAi HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM THE SITE, THE SERVICES, THE INABILITY TO USE THE SERVICES, MESSAGES RECEIVED OR SENT, TRANSACTIONS ENTERED, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSION OR DATA, CONDUCT OR STATEMENTS OF ANY THIRD PARTY USING THE SERVICE, OR ANY OTHER MATTER RELATING TO THE SERVICE WHETHER DAMAGES ARISE UNDER THEORY OF TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY, OR OTHERWISE.

YOU RELEASE US FROM ALL LIABILITY FOR YOU HAVING NOT ACQUIRED OR ACQUIRED CONTENT THROUGH THE SERVICES. WE MAKE NO REPRESENTATIONS CONCERNING ANY CONTENT ACCESSED THROUGH OR CONTAINED IN THE SERVICES.
